This Terms of Service Agreement (“Agreement”) is a legally binding contract between you (“User,” “you” or “your”) and My Mobile Massage (“we,” “us” or “our”) governing your use of the website mymobilemassage.ca (“Website”) and its related products and services (“Services”). By accessing or using the Website or Services, you agree to be bound by this Agreement. If you are using the Website or Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.

 

1. Eligibility and Accounts

  • Age Requirement: You must be at least 18 years old.

  • Account Security: If you create an account, you are responsible for its security and all activities under it. Provide accurate contact information; false information may result in termination.

  • Unauthorized Access: Notify us immediately of any unauthorized use of your account.

  • Account Termination: We may suspend, disable, or delete your account if you violate this Agreement or if your conduct damages our reputation. In such cases, re-registration may be prohibited.

 

2. Billing and Payments

  • Fees: You agree to pay all applicable fees in accordance with the current pricing and billing terms.

  • Changes and Cancellations: We reserve the right to change products, pricing, or cancel bookings. You may be notified via email or phone if a booking is altered or canceled.

  • Booking Limits: We may limit or cancel bookings based on account, credit card, or billing address restrictions.

 

3. Accuracy of Information

  • Website Content: While we strive for accuracy, the Website may contain errors or omissions (e.g., in product descriptions, pricing, availability). We reserve the right to update or correct any information without prior notice.

  • No Guarantee of Updates: No update date on the Website guarantees that all information is current.

 

4. Links to Third-Party Resources

  • The Website may contain links to external resources (websites, mobile apps, etc.). We do not endorse or assume any responsibility for the content, products, or services of these third parties. Use any linked resource at your own risk.

 

5. Prohibited Uses

You agree not to use the Website or Services:

  • To violate any laws or regulations.

  • No Guarantee: We do not warrant that the Services will be uninterrupted, secure, error-free, or meet your requirements.

  • Risk: Any material or data obtained through the Services is at your own risk.

 

8. Limitation of Liability

  • No Indirect Damages: To the fullest extent permitted by law, My Mobile Massage and its affiliates will not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, revenue, or goodwill).

  • Aggregate Liability: Our total liability is limited to the greater of one dollar ($1) or the total amount paid by you in the preceding month.

 

9. Indemnification

You agree to indemnify and hold harmless My Mobile Massage and its affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Website or Services or any breach of this Agreement.

 

10. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

 

11. Assignment

  • User Restrictions: You may not assign or transfer your rights or obligations under this Agreement without our prior written consent.

  • Our Rights: We may assign our rights or obligations under this Agreement to any third party without notice.

 

12. Changes and Amendments

We reserve the right to modify this Agreement at any time. Changes will be effective upon posting on the Website, and your continued use of the Services constitutes your acceptance of the revised terms.

 

13. Acceptance

By accessing and using the Website and Services, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, do not use the Website or Services.

15. Service-Specific Policies

15.1 Safe Access & Parking

  • Access: Clients must provide a safe, unobstructed parking space for therapists to unload and reload equipment.

  • Alternate Parking: If safe parking is unavailable within 200 meters, a secondary parking fee may apply, and treatment time may be reduced (up to 30 minutes).

  • Delayed Parking: If no safe space is found within 30 minutes, the therapist will cancel the booking and the client will be charged half the booked service fee.

  • Responsibility: Clients are financially responsible for delays or alterations due to parking restrictions.

15.2 Residence Requirements

  • Safe Access: Clients must ensure that their residence is free of obstructions (e.g., snow, ice, toys, plants) and hazards.

  • Work Area: An open, hazard-free work area must be provided.

  • Pets and Children: For health and safety, pets and children must not be in the designated treatment area during the appointment.

  • No Furniture Moving: Therapists are not responsible for moving furniture or personal items.

  • Liability: Clients are responsible for any damage or injury resulting from non-compliance with these requirements. Failure to provide safe access may lead to immediate cancellation and applicable service fees.

15.3 Cancellations

  • Notice Requirement: A minimum of 24 hours’ notice is required to cancel, reschedule, or alter an appointment (excluding minor start time delays).

  • Late Cancellation: Failure to provide proper notice will result in a full charge of the booked service.

15.4 Start Times

  • Estimated Start: Appointments are scheduled based on estimated start times. Delays may occur due to traffic, weather, or emergencies.

  • Delay Notification: If a delay exceeds 10 minutes (up to a maximum of 20 minutes), the therapist will notify the client, who may then reschedule at no extra cost.

  • Therapist Cancellations: Therapists may delay or cancel appointments at no cost to the client under extenuating circumstances.

15.5 Therapist Qualifications and Assessment

  • Qualifications: All therapists are fully trained, certified, licensed, and have passed criminal and vulnerable persons background checks.

  • Physical Assessment: Therapists provide physical assessments to determine treatment needs. Such assessments do not constitute a medical diagnosis. Clients must consult a medical professional for diagnosis and advice.

15.6 Cleaning and Sanitization

  • Therapists will:

    • Sanitize equipment and bags with Health Canada-approved disinfectants.

    • Wear KN95 masks as required.

    • Sanitize hands before entering the client’s residence and use personal soap and towels they supply.

    • Manage linens separately, washing them with bleach, high heat, and detergent.

15.7 Licensing & Professional Conduct

  • Therapists must maintain professional standards, including continuing education, insurance, and licensing requirements.

  • Zero Tolerance Policy: My Mobile Massage enforces a strict non-discrimination policy and zero tolerance for any form of sexual harassment, solicitation, or inappropriate conduct by therapists or clients. Violations will result in immediate termination of service and may be reported to authorities.

15.8 Personal Information

  • Health Screening: Clients must complete an Online Health History Form and an illness pre-screening waiver before treatment.

  • Confidentiality: All personal information is kept confidential per the Personal Health Information Act (PHIA) and stored in Canada according to our privacy policies.

15.9 Social Media

  • Clients are requested to contact us directly with any concerns before posting on social media. Harassing, disparaging, or offensive content about My Mobile Massage, its staff, or therapists is not permitted.

15.10 Booking

  • Online Booking: All appointments must be booked online.

  • Credit Card: A valid credit card is required at booking to secure your appointment and will be charged if cancellation policies are violated. Payment information is stored per our Personal Information policies.

15.11 Medical Advice

  • Clients are advised to consult a doctor before booking to ensure it is safe to receive massage therapy. Massage therapy is not a substitute for professional medical advice, diagnosis, or treatment.

15.12 Amendments to Service Policies

  • We reserve the right to amend these service-specific policies as necessary. Continued use of our Services constitutes acceptance of any changes.

 

By using our Website and Services, you acknowledge that you have read, understood, and agree to all the terms and policies contained in this Agreement.
